Houston Drone Video Production is a video-production and marketing business. We are not a healthcare provider, health plan or healthcare clearinghouse merely because we operate this website or provide video-production services.

The fact that we work for a healthcare organization does not automatically mean that every project involves PHI or that Houston Drone Video Production is acting as a HIPAA business associate.
Many productions can be planned so that our crew does not need access to PHI.

Business Associate Agreements
In some circumstances, the nature of a healthcare project may cause a vendor to qualify as a business associate under HIPAA.
Where a healthcare client determines that a project will require Houston Drone Video Production to create, receive, maintain or transmit PHI in a manner that requires a Business Associate Agreement (“BAA”), that requirement must be identified and agreed upon before PHI is provided to us.
If we agree to perform work requiring us to act as a HIPAA business associate, the applicable obligations should be addressed through an appropriate written agreement, which may include a BAA and project-specific requirements concerning:

Patient Filming, Interviews and Releases

The healthcare client remains responsible for determining what patient authorizations, notices, releases, consents or other approvals are required under HIPAA, state law, facility policy or other applicable rules unless a written production agreement expressly assigns a particular responsibility to us.
We may require confirmation that appropriate permissions have been obtained before filming identifiable patients or using patient-related material.
A standard appearance release or video-production consent does not necessarily replace a HIPAA authorization when HIPAA requires one.
Healthcare Facilities
When filming inside hospitals, clinics or other healthcare locations, we may follow facility requirements concerning:
approved filming areas;
escorts;
patient privacy;
restricted areas;
screens, whiteboards and medical records;
badges;

and other site requirements.
We may stop or change filming when patient information, restricted activity or another privacy concern unexpectedly enters the production area.
