These Terms of Use (“Terms”) govern your access to and use of the Houston Drone Video Production website, including its pages, content, forms, images, videos and other materials available through the website (collectively, the “Site”).
The Site is operated by Houston Drone Vide, doing business as Houston Drone Video Production (“Houston Drone Video,” “we,” “us” or “our”), located in Houston, Texas.
By accessing or using the Site, you agree to these Terms. If you do not agree with these Terms, please do not use the Site.
1. Purpose of This Website
Houston Drone Video Production provides information about professional video-production services, including drone and aerial video, indoor FPV drone filming, construction timelapse, interviews, corporate video production, training and orientation videos, event coverage, editing and related production services.
The Site is intended primarily to provide information about our capabilities, experience, pricing ranges and production process and to allow prospective customers, agencies and other parties to contact us regarding potential projects.
Information appearing on the Site is provided for general informational and marketing purposes. It does not constitute a binding proposal, production agreement or guarantee that a particular service, crew, piece of equipment, production method, price, delivery schedule or filming location will be available.
2. Website Terms vs. Client Production Agreements
These Terms govern use of the Site.
They do not replace a separate proposal, estimate, statement of work, production agreement, purchase order or other written agreement entered into between Houston Drone Video and a client.
Any actual video-production engagement may be subject to additional terms covering matters such as pricing, deposits, payment schedules, cancellations, rescheduling, weather, travel, revisions, raw footage, licensing, intellectual-property rights, releases, permits, insurance, delivery dates and project-specific responsibilities.
If these Website Terms conflict with a separately signed agreement governing a specific client project, the signed project agreement controls with respect to that project.
Submitting a contact form, requesting an estimate, exchanging emails or discussing a project does not by itself create a binding production agreement.
3. Service Descriptions and Pricing
We try to describe our services, production capabilities and typical pricing accurately. However, video-production projects vary substantially.
Pricing ranges displayed on the Site are estimates or examples only unless expressly stated otherwise in a written proposal.
Actual pricing may depend on factors including:
location;
crew size;
equipment requirements;
filming duration;
site access;
travel;
airspace;
permits or approvals;
interviews;
audio and lighting requirements;
editing;
graphics;
number of deliverables;
turnaround time; and
other project-specific conditions.
We may modify service descriptions, pricing ranges, equipment, packages or availability at any time.
A price displayed on the Site does not constitute a binding offer.
4. Drone and Aerial Filming
Any description of drone, aerial or FPV services on the Site is subject to actual operating conditions.
Drone flight may depend on factors including FAA regulations and authorizations, controlled or restricted airspace, temporary flight restrictions, property permission, nearby airports or heliports, weather, visibility, people, traffic, equipment, structures, power lines, cranes, site safety requirements and other conditions.
We do not guarantee that a drone can legally or safely operate at every requested location or at every requested time.
If aerial flight is unavailable or unsuitable, we may recommend alternative production methods. Any alternative approach will depend on the project and may affect scope, cost, schedule or deliverables.
Nothing on this Site should be interpreted as aviation, regulatory or legal advice.
5. Estimates and Project Inquiries
You may use the Site to request information or provide details about a potential project.
Any estimate provided in response to an inquiry may be based on the information available at that time. Estimates may change if project scope, locations, schedules, access, crew requirements, equipment, deliverables or other assumptions change.
Unless specifically stated otherwise in writing, an estimate is not a reservation of crew, equipment or production dates.
A project is considered booked only under the booking requirements stated in the applicable proposal or production agreement.
6. Information You Submit
When you submit information through a contact form, email or other communication method, you agree that the information you provide is reasonably accurate and that you have the right to provide it.
You should not submit passwords, financial account information, Social Security numbers, medical information, export-controlled information, confidential government information or other highly sensitive information through an ordinary website contact form.
Information submitted through the Site may be used to respond to your inquiry, prepare an estimate, plan a potential project, maintain business records, improve our services or communicate with you as described in our Privacy Policy.
Your use of the Site is also subject to our Privacy Policy.
7. Intellectual Property
The Site and the materials we own on it, including original text, graphics, design elements, branding, photographs, video, animations and other content, are protected by applicable copyright, trademark and other intellectual-property laws.
You may view the Site for personal or legitimate business-evaluation purposes.
Unless we give you written permission, you may not:
reproduce substantial portions of the Site;

sell, license or commercially redistribute Site content;

8. Client Work, Third-Party Materials and Trademarks
The Site may contain examples of client projects, client logos, trademarks, facilities, products or other third-party materials.
All third-party trademarks, service marks, logos and other intellectual property remain the property of their respective owners.
Their appearance on the Site does not necessarily imply endorsement, sponsorship or an ongoing business relationship.
Certain photographs, footage or project materials may be displayed as examples of work performed or production experience. Rights in individual project materials may belong to Houston Drone Video, a client or another rights holder depending on the applicable project agreement.
You may not assume that material displayed in our portfolio is available for reuse.
9. Acceptable Use
You agree not to use the Site in a way that interferes with its normal operation or violates applicable law.
You may not knowingly:
attempt to gain unauthorized access to the Site or associated systems;
introduce malicious code, malware or harmful software;
interfere with website security or availability;

Unless expressly stated otherwise, Site content should not be treated as legal, financial, engineering, architectural, safety, aviation, regulatory or other licensed professional advice.
Clients remain responsible for obtaining appropriate advice from their own qualified professionals when a project requires it.
14. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HOUSTON DRONE VIDEO PRODUCTION AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE.
THIS INCLUDES, WITHOUT LIMITATION, CLAIMS FOR LOST PROFITS, LOST BUSINESS OPPORTUNITIES, LOST DATA OR BUSINESS INTERRUPTION ARISING FROM RELIANCE ON WEBSITE CONTENT OR WEBSITE AVAILABILITY.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
Liability relating to an actual paid video-production project is governed by the applicable proposal, production agreement or other written contract and not by this Website Terms section except where that agreement expressly incorporates these Terms.
16. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Houston Drone Video Production, its owners, officers, employees, contractors and affiliates from third-party claims, liabilities, damages, costs and reasonable attorneys' fees arising directly from:
your unlawful misuse of the Site;
information or materials you submit without the necessary rights or permission;
your infringement of another person's intellectual-property or privacy rights through your use of the Site; or
your material violation of these Terms.
This provision does not require you to indemnify us for claims caused solely by our own unlawful conduct where such indemnification would be prohibited by law.
17. International Access
Houston Drone Video Production is based in Houston, Texas, United States.
The Site may be accessible from other states or countries, but we do not represent that Site content or services are appropriate, available or legally compliant in every jurisdiction.
Users accessing the Site from outside Texas or outside the United States are responsible for complying with laws applicable to them.
18. Governing Law and Venue
These Terms and disputes arising specifically from use of the Site will be governed by the laws of the State of Texas, without regard to conflict-of-law principles.
To the extent permitted by law, any legal action arising specifically from these Terms or use of the Site will be brought in the appropriate state court located in Harris County, Texas, or in the United States District Court for the Southern District of Texas, Houston Division.
You consent to the personal jurisdiction of those courts for disputes governed by this section.
A separately signed client agreement may contain different dispute-resolution or venue provisions. If so, that agreement controls for disputes arising from the applicable client project.
19. Changes to These Terms
We may update these Terms from time to time to reflect changes to the Site, our business practices or applicable requirements.
The current version will be posted on this page with an updated effective date.
Changes apply to use of the Site after the updated Terms are posted.
We do not rely on these Website Terms to retroactively change a separately signed client agreement.
20. Severability
If a court determines that any provision of these Terms is invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
An invalid or unenforceable provision should be interpreted or limited, where legally permissible, in a way that most closely reflects its intended purpose.
21. No Waiver
Our decision not to enforce a provision of these Terms on one occasion does not waive our right to enforce that provision later.
22. Entire Website Agreement
These Terms and the Privacy Policy constitute the agreement between you and Houston Drone Video Production concerning your use of the Site.
They do not replace or supersede a separately executed client proposal, production agreement, statement of work or other written contract governing paid production services.
